1. Scope of Application
1.1. These General Terms and Conditions (GTC) apply to all contracts concluded between Achinger Lavender and consumers via the online shop achinger-lavendel.at be concluded.
1.2. Consumers within the meaning of these GTC are natural persons within the meaning of the Consumer Protection Act (KSchG). For customers residing in Germany, the mandatory consumer protection provisions of German law also apply.
1.3. Deviating or supplementary terms and conditions of the customer do not become part of the contract unless expressly agreed to in writing.

According to § 6 para. 1 no. 27 of the German VAT Act (small business regulation), no VAT is shown.
A VAT number is not required at this time.
3. Customer base and delivery area
3.1. The offer is aimed exclusively at consumers.
3.2. Deliveries are made to Austria and Germany.
4. Object of performance
4.1. Achinger Lavendel sells agricultural products, in particular lavender products, essential oils, hydrosols and syrups.
4.2. The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
4.3. Slight deviations in colour, shape, fragrance or packaging due to nature or production do not constitute a defect.
5. Conclusion of Contract
5.1. The order is placed via the online shop.
5.2. By clicking on the "Buy now" button, customers submit a binding offer to conclude a purchase contract.
5.3. The contract is concluded as soon as Achinger Lavendel expressly confirms the order by e-mail or ships the goods.
5.4. The text of the contract is stored and sent to the customer by e-mail after conclusion of the contract.
6. Prices and Terms of Payment
6.1. All prices are quoted in Euro (€) and are final prices. Achinger Lavendel is subject to the small business regulation according to sec. 6 para. 1 no. 27 of the German VAT Act. Therefore, no VAT is shown or charged.
6.2. In addition to the product prices, shipping costs are incurred, which are shown separately during the ordering process.
6.3. Free shipping costs from an order value of €50 applies exclusively to deliveries to Austria.
6.4. The following payment methods are available:
- Prepayment (bank transfer)
- Online payment services (e.g. PayPal; depending on availability in the online shop)
7. Delivery
7.1. Delivery shall be made to the delivery address specified by the Customer.
7.2. The delivery time shall generally be 2–5 working days after receipt of payment, unless otherwise stated for the Product.
7.3. Partial deliveries shall be permitted provided that they are reasonable for the Customer.
8. Transfer of Risk
In the case of consumers, the risk of accidental loss or accidental deterioration of the goods only passes when they are handed over to the customer.
9. Retention of title
The goods remain the property of Achinger Lavendel until full payment has been made.
10. Warranty
10.1. The statutory warranty provisions apply.
10.2. In the case of food and natural products, deviations in taste, colour or other natural nature do not constitute a defect.
11. Liability
11.1. Achinger Lavendel shall be liable without limitation for damages caused intentionally or through gross negligence.
11.2. In the event of slight negligence, Achinger Lavendel shall only be liable in the event of a breach of essential contractual obligations.In this case, liability shall be limited to the typically foreseeable damage.
11.3. Liability under the Product Liability Act remains unaffected.
12. Product Notes
12.1. The products offered are not medicinal products and do not replace medical advice.
12.2. No promises of healing are made.
12.3. Essential oils are sold exclusively as raw materials or consumer goods. A specific effect or purpose is not assured. Proper use is the responsibility of the customer.
13. Data protection
The processing of personal data is carried out exclusively on the basis of the applicable data protection laws (GDPR). Further information can be found in the privacy policy, which is available on the website at any time.
14. Alternative dispute resolution
Achinger Lavendel is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board. Consumers have the option of filing complaints via the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr
15. Cancellation policy for consumers
15.1. In the case of distance contracts, consumers have a statutory right of withdrawal in accordance with the Distance and Away Transactions Act (FAGG).
15.2. The "Cancellation Policy for Achinger Lavender – as of December 2025" is an integral part of these General Terms and Conditions.
15.3. The cancellation policy is made available to the customer on a durable data carrier (e.g. by e-mail) before placing the order and after the contract has been concluded and is also available on the website at any time.
15.4. In the event of a contradiction between these GTC and the cancellation policy, the provisions of the cancellation policy shall prevail.
16. Final Provisions
16.1. The law of the Republic of Austria shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies to the extent that it does not restrict mandatory provisions of the law of the country of habitual residence.
16.2. The language of the contract is German.
16.3. Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by an effective provision that comes closest to the economic purpose.
